PETALING JAYA: The Kota Kinabalu sessions court today sentenced a foreigner to 20 years’ imprisonment and 10 strokes of the rotan for raping his teenage daughter two years ago.
Judge Marlina Ibrahim ruled that the 44-year-old illegal immigrant had failed to cast reasonable doubt on the prosecution’s case, Borneo Post reported.
According to the facts of the case, the man raped his then 16-year-old daughter in a rented room at Inanam Point on July 6, 2024.
The charge against him was brought under Section 376(3) of the Penal Code, which provides for eight to 30 years’ imprisonment, and not less than 10 strokes of the rotan upon conviction.
Deputy public prosecutor DK Afiqah Alya AK Johari @ Pg Johari produced four witnesses to testify against the accused during the prosecution stage. The accused, who was unrepresented, was the sole witness for his defence.
The court ordered for the man’s imprisonment to begin from the date of his arrest on July 8, 2024 and for him to be referred to the immigration department for further action upon completing the sentence.
