PUTRAJAYA: Rosmah Mansor has applied to the Court of Appeal for leave to adduce fresh evidence in her appeal against her conviction in the RM1.25 billion solar hybrid project corruption case.
In a notice of motion dated July 21, Rosmah sought permission under Section 61 of the Courts of Judicature Act 1964, and Rules 68 and 69 of the Court of Appeal Rules 1994, to rely on three additional documents as evidence during the hearing of her appeal.
In an affidavit supporting the application, sighted by FMT, Rosmah claimed that prosecution witness Rayyan Radzwill Abdullah was pressured into giving incriminating evidence against her during the trial.
She submitted a covering letter from Messrs Shamsuddin & Co dated July 10 and a police report lodged by Rayyan on the same day.
She also submitted a statutory declaration sworn by Rayyan on July 10, together with its attachments, including a supplementary affidavit dated Aug 3, 2020.
Rosmah, the wife of former prime minister Najib Razak, is also seeking leave to recall Rayyan to give further evidence before either the Court of Appeal or the High Court.
If allowed, she wants his additional oral testimony to be recorded and admitted as fresh evidence in the appeal.
The application will be heard on Sept 1.
She has also asked the court to stay the hearing of her appeal, which is scheduled to run over 11 days from Sept 1 to Sept 30, pending the disposal of the application.
On Sept 2, 2022, High Court judge Zaini Mazlan convicted Rosmah of soliciting RM187.5 million from former Jepak Holdings Sdn Bhd managing director Saidi Abang Samsudin, through her former aide Rizal Mansor, as an inducement to help the company secure the solar hybrid project.
She was also found guilty of receiving RM5 million from Saidi through Rizal at Seri Perdana in Putrajaya on Dec 20, 2016, and a further RM1.5 million at her residence in Jalan Langgak Duta on Sept 7, 2017.
Zaini sentenced Rosmah to 10 years’ imprisonment on each of the three charges, with the jail terms to run concurrently. He also imposed a RM970 million fine and ordered her to serve an additional 10 years in prison if the fine is not paid.
